Settlement with the Committee on Unlawful Practices
During the course of litigation, several constitutional issues were raised in the case, and one of these issues involved the Record of Proceedings on Unlawful Practices Committee.
The Supreme Court of Appeals did not weigh the relative merits of the different review paths, but instead simply stated that it did not “have any particular inclination to decide whether the paths were well suited for the particular facts in this case.”
In the course of litigation, the National Association of Professional Allstate Agents (“NAPAA”) alleges that Allstate Insurance Company (“Allstate”) has acted in bad faith by imposing unreasonable restrictions on the sale of its policies to NAPAA members.
Allstate’s conduct constituted a breach of contract, and the NAPAA has suffered damages as a result.
Allstate also acted in bad faith in requiring NAPAA members to purchase Allstate’s phone system, as well as in interfering with the agents’ book sales negotiations.
At a hearing in this case, Allstate presented a written argument in support of its motion to dismiss the complaint and seek a preliminary injunction.
At the hearing, the Committee heard Allstate’s argument that the path of relief in this case was an “unfair competition” writ of prohibition, which would prevent Allstate from imposing unreasonable restrictions on the sale of its insurance products.
The Committee declined to reconsider its position and asked Allstate to respond.
In addition, Allstate also argued that its path of review was different than the path available in Thomas v.
Home and Marine Ins.
Co., which was affirmed by the Fourth Circuit in 2010.
Allstate argued that it could file an instant complaint in state court under equity jurisdiction and seek a writ of prohibition.
While Allstate has a viable path of review in state court, it will likely be considered too late to be considered at this point.
Regardless of which path of review is utilized, a 998 offer must be reasonable.
It must realistically foreshadow the outcome of the case, and must also accurately reflect damages estimated in trial.
If the offer is not reasonable, the court may deny it.
The court will also consider the merits of the lawsuit and the liability of the insurer.
It may also award treble damages up to $1,000.
If the plaintiff can prove that the defendant’s conduct was materially deceptive, then he or she may be entitled to compensatory damages.
However, if the defendant can show that he or she did not knowingly engage in materially deceptive behavior, the court may award attorney’s fees.
In addition, Allstate also claims that the Opinion constituted an “unfair practice” under the Commerce Clause of the Constitution, a violation of the First Amendment, and a violation of the First Amendment’s prohibition of unconstitutional interference with the free exercise of religion.
The Committee agreed to stay the implementation of the Opinion until October 28, and agreed to not enforce it until the court resolves the relevant issues.
